Advocate Salem Abdul-Khader El-Atrash

Half a century ago, El-Atrash Law Practice was established in Libya when the office was founded in 1951 by Mr. Salem Abdul Khader El-Atrash.

From the early days, Mr. El-Atrash Senior's courageous commitment to the defense of human rights was an integral part of his principles.

These principles brought him to the fore in what came to be known as the most delicate cases in Libyan judicial history.

By undertaking these cases Mr. Salem El-Atrash was able to make a generous contribution in the legal and judicial arena, participating in the creation of numerous legal principles which remain an integral part of the judicial system. Over the years these legal principles have been applied by all levels of courts, including the Supreme Court.

The active and sustained effort of Mr. Salem El-Atrash throughout the years of his career meant that these principles gained the highest level of legal and judicial application in all fields of law, in particular administrative, penal, civil and constitutional law.

Born in Benghazi in 1950, Dr. Sami El-Atrash gained his legal qualifications in 1974 at the Libyan University, Benghazi before joining his father Advocate Salem El-Atrash in legal practice in his Benghazi law offices. From 1974 to 1978 he worked as an advocate before Benghazi First Instance Court before being admitted to appear before the Appeal Court in 1978. During this period, he gained experience in the civil, criminal, commercial and administrative fields, representing both Libyan and foreign individuals and companies, in particular, several Greek, British, Italian and Lebanese individuals and firms in several legal and judicial area of law.

During this stage El-Atrash Law Firm was honoured to be given the opportunity to participate and contribute effectively in the rebuilding of the Lebanese national economy during and after the civil war through its representation of several Banks and companies in the commercial sector where debt collection was the field of operation with successful results.

As an appeal court lawyer, his work continued in the same field until the promulgation of law 4/81 and its amendment of the private law profession offices in 1981. At this time, Dr. El-Atrash took the opportunity to broaden his experience by working in Europe as a legal advisor to foreign and national companies and individuals, in cooperation with other Arab Advocates, including the Arab Advocates Office in Beirut.

From 1982 until 1990, Dr. El-Atrash undertook postgraduate research in the Department of Public International Law at Glasgow University in the United Kingdom, where he was awarded the degrees of Master of Laws in 1986 and Doctor of Philosophy in 1990.


Re-establishment

In 1991, El-Atrash Law Firm was re-established in the Libyan Jamahiriya in partnership with Supreme Court Lawyers, Salem El-Atrash and Samih El-Atrash, and a branch office was opened in Athens in 1990. Our Libyan head office and branch office in Athens resumed our office's role of reliable, timely and successful representation of Libyan and as well as foreign clients both in the public and private sectors.

Although our Athens branch office was able to maintain our office's tradition of providing a reliable, swift and effective service to both Libyan and foreign clients, in view of the difficulties presented by continuing international sanctions against the Jamahiriya, the decision was taken in 1997 to re-locate our overseas office to the Republic of Malta which offers the best strategic location to continue to provide efficient service to our clients.

A major national client in the Jamahiriya is Germa Shipping & Stevedoring Company, whom our offices represented in collections of outstanding agency fees from ship owners and maritime companies all over the world. Another was the Libya Insurance Company, whom our offices represented in the collection of foreign insurance claims and the implementation of judgments. In the maritime field we have also successfully represented foreign ship-owners and Protection and Indemnity Associations.
